Terms of Sale/Service

1. General

These Terms of Sale/Service govern all purchases made through this website. By purchasing any digital or physical image (the “Product”), you agree to comply with and be bound by these terms.


2. Products and Licensing

All images are sold either as digital downloads or physical prints. Unless stated otherwise, the purchase of a digital file whether printed or remaining in digital form grants you a non-exclusive, non-transferable license for personal use only. You may not resell, distribute, modify, or use images for commercial purposes without a written license agreement from David G. Creagh doing business as DC Photography (heretofore known as DC Photography).


3. Payment

All prices are stated in U.S. dollars and are subject to change without notice. Payment must be received in full before any digital delivery or product shipment occurs.


4. Delivery

Digital products will be delivered via email or direct download link after successful payment. Physical prints will be shipped to the address provided at checkout. Delivery timeframes may vary depending on location.


5. Refunds and Exchanges

Due to the nature of digital products, all sales of digital images are final. Physical products may be exchanged or refunded only in cases of damage or printing error reported within 7 days of receipt.


6. Copyright and Ownership

All images remain the sole property of DC Photography. The purchase of a product does not transfer copyright ownership. Unauthorized reproduction or commercial use constitutes copyright infringement.


7. Limitation of Liability

DC Photography is not liable for any indirect, incidental, or consequential damages arising from the purchase or use of the products.


8. Governing Law

These terms are governed by and construed in accordance with the laws of the State of Hawaii, without regard to its conflict of law principles.
